HHR PERFORMANCE - TERMS & CONDITIONS OF SALE AND WEBSITE USE

1. ORDER ACCEPTANCE

When you place an order with HHR Performance, you will receive an automatic confirmation email. This does not signify our acceptance of your order, but rather confirmation that we have received it. Your order represents an offer to purchase products from us, which is accepted by us only once the order has been processed and shipped.

We reserve the right to delay or cancel any order containing incomplete, unverifiable, or potentially fraudulent information. Orders may also be delayed due to supplier or production lead times.

2. SHIPPING, DELIVERY & TRACKING

  • All orders are subject to availability and may ship separately based on stock.

  • Orders will only be shipped once all items are in stock, unless the customer elects to pay additional shipping fees to split the order. Customers will be contacted if an item is out of stock and provided with the following options:

    • Pay for split shipping to ship in-stock items immediately and send the remainder when available

    • Wait until all items are in stock and ship together

  • We cannot guarantee same-day shipping due to limited carrier pickup windows and time zone differences across the country.

  • All shipments include tracking and may require a signature for delivery. We do not ship to freight forwarding addresses.

  • If your FedEx tracking shows delivery to the wrong location, contact FedEx at 1-800-463-3339 immediately with your tracking number. Notify us as well. We will not issue a refund until FedEx has resolved the case with us.

3. SHIPPING DAMAGES

Inspect all packages for visible damage before signing for delivery. If you notice damage:

  • Note it on the driver’s paperwork.

  • Request a signed copy from the driver.

  • Do not refuse the shipment.

  • Report damage within 2 days of delivery to sales@hhrperformance.com.

4. RETURNS & REFUNDS

If you are unsatisfied with your purchase, please email sales@hhrperformance.com to initiate a return within 30 days of delivery.

Products must be unused and returned in their original condition. No cancellation, refund, or return will be accepted if the product has been used in any way.

Repackage the product in its original packaging, including any accessories, brochures, manuals, guarantees, or warranties that came with it. Unfortunately, we will be unable to issue a refund if the product is incomplete or damaged in any way. Absolutely no returns are accepted on electronic components such as quickshifters, data loggers, and fuel injection systems.

Return Conditions:

  • Products must be unused, in original packaging, with all tags and materials.

  • All non-defective returns are subject to a 20% restocking fee.

  • No returns accepted for special/custom orders unless defective.

  • No returns on products damaged through installation or tampering.

Return Instructions:

  • Include a copy of your sales invoice.

  • Pack items securely. We recommend using a trackable, insured shipping method with signature required.

  • Customer is responsible for all return shipping costs.

  • We are not liable for lost or stolen return packages; claims must be filed with the carrier.

5. ORDER CANCELLATIONS

All order cancellations are subject to a $20 cancellation fee. Orders that have shipped or entered production are subject to a 20% restocking fee.

Orders placed via Affirm financing are subject to a 20% cancellation fee regardless of fulfillment status due to administrative processing.

6. WARRANTY

HHR Performance provides products as supplied by the manufacturer and does not offer any warranty—express or implied—beyond what is provided directly by the product manufacturer. Any issues, defects, or failures must be resolved with the manufacturer in accordance with their warranty policy. While HHR Performance may assist with basic guidance, all warranty claims must be pursued directly with the manufacturer.

7. INTERNATIONAL ORDERS

International buyers are responsible for any applicable customs duties, taxes, or tariffs. Shipments may be delayed or inspected by customs. We do not provide advice on import regulations. Some products may not be eligible for international shipping due to manufacturer distribution restrictions. International shipping is billed at actual or volumetric weight, whichever is greater.

8. PRODUCT PRICING

  • Prices are subject to change without notice.

  • Errors in pricing may result in order cancellation or revision.

  • Title of goods transfers to the buyer upon full payment and shipment.

9. PAYMENT SECURITY

All transactions on our website are processed through Shopify’s secure and PCI-compliant payment platform. Shopify uses industry-standard encryption and security protocols to ensure your payment details are protected. HHR Performance does not store any credit card information, and all payment data is handled directly by Shopify’s secure checkout system.

10. LIMITATION OF LIABILITY

HHR Performance shall not be liable for indirect, incidental, or consequential damages arising from product use or inability to use. All products sold should be installed by a qualified mechanic. Improper installation or misuse may void any manufacturer warranty and is the responsibility of the purchaser. We are not responsible for shipping delays caused by factors outside our control (weather, strikes, etc.).

11. WEBSITE USE LICENSE

You may view, cache, and link to individual pages of our website for personal use. You may not modify, republish, or deep link to our site content without prior written consent.

12. INTELLECTUAL PROPERTY

All content, graphics, and layouts are property of Hustlehard Racing LLC. Unauthorized copying, extraction, or redistribution is strictly prohibited.

13. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of the State of Florida. Disputes must be brought exclusively in the courts of Florida.

14. DEFINITIONS

  • "We/Us/Our": Hustlehard Racing LLC (HHR Performance).

  • "You/Your": The purchaser of goods from our site.

  • "Goods": The products you purchase from us.

15. CUSTOMER ACCOUNT SECURITY

Customers are responsible for maintaining the confidentiality of their account credentials. Notify us immediately if you suspect unauthorized access.
